Portal Privacy Policy

Portal Privacy Policy and Terms of Use

Welcome to the Association of Cancer Care Centers. This Portal Privacy Policy and Terms of Use (this “Privacy Policy”) entered into by and between the Association of Cancer Care Centers (“ACCC”, “we”, “our,” or “us”) and User (as defined below), and the organization or entity (the “Member”) on behalf of which User is accessing the portal accessible through https://cmanagementinc.my.site.com/ (the “Portal”), including the ACCCeXchange, as applicable.

This Privacy Policy does not pertain to other information that is collected offline or to information that is posted or provided by third parties or to the public-facing portions of www.accc-cancer.org/. By accessing and using the Portal, User hereby binds the User and Member (if applicable) to the terms and conditions of this Privacy Policy.

This Privacy Policy is effective as of October 15, 2024.

1. Access to and Use of the Portal

ACCC shall make the Portal available to individual users authorized by ACCC and the Member (if applicable) (“Users”). ACCC may approve an individual as an Authorized User if the individual (a) is at least eighteen (18) years of age; and (b) is a resident of the United States of America. ACCC may approve, deny, modify, suspend, or terminate an individual request to be, or status as, a User at any time in its sole reasonable discretion.

A User’s access to and use of the Portal shall be subject to, and dependent upon compliance with, this Privacy Policy, our Community Guidelines, and all terms and conditions set forth herein. If applicable, Member shall ensure that its Users comply in full with the terms and conditions of this Privacy Policy.

2. Information Collected

  1. Voluntarily. In order to access the Portal, Member and/or User may provide to us certain personal information, including, but not limited to, name, job title, work email address, work phone number, home phone number, mailing address, and credit/debit card information. In addition, User may choose to share personal information with us voluntarily while accessing the Portal. For example, User may choose to register for events or webinars, or send us or other Users messages via the Portal. If a User decides to share any personal information via the ACCCeXchange, the User does so at their own risk, as any content posted on the ACCCeXchange will be visible to all Portal Users. Please see our Community Guidelines for more information about use of the ACCCeXchange.
  2. Automatically. We may automatically collect certain information when User uses the Portal. For example, we may collect identifying information that allows us to track the number of Users of the Portal. The types of identifying information collected may include the date and time User uses the Portal, the User’s IP address and associated location information, as well as the operating software and browser being used to access or use the Portal.

The Portal also utilizes “cookies” to collect certain information. A “cookie” is a small text file that may be used to collect information about User activity on the Portal or to track users across the Internet. For example, when User visits a page within the Portal, a cookie may be placed on the User’s machine (if the User accepts cookies) or is read if the User has visited the Portal previously. Some of the cookies we use may be flash cookies or Adobe cookies. User may set most browsers to notify the User if User receives a cookie, or User may choose to block cookies with the browser, but if User does, certain features of the Portal may be unavailable. We employ first-party cookies to optimize API performance, offer e-commerce options, regulate User session volumes, and preserve the state of individual sessions, among other functions necessary for a seamless User experience. Additionally, third-party cookies from providers such as Google Analytics, Feathr, and Vimeo are utilized to analyze Portal traffic and interactions, enabling us to improve our services and tailor content to better suit your preferences. By continuing to use the Portal, you consent to the use of these cookies as outlined in this Privacy Policy.

If User does not want ACCC to collect this information, please do not visit the Portal.

3. Use of Information Collected Via the Portal

We may use information that is collected on the Portal for the following purposes:

  • To provide Users with requested services (e.g., webinar, event, or course registration).
  • To operate, improve, manage, and protect the Portal.
  • To ensure the Portal is relevant to the Member (if applicable) and Users.
  • To notify Users of a material change to this Privacy Policy.
  • To perform functions or services pursuant to the applicable Standard Terms and Conditions.

4. Sharing and Disclosure of Information

  • In order to provide the Portal and other services to User and the Member (if applicable).
  • To our affiliates and unaffiliated third-party service providers, agents or independent contractors who help us maintain the Portal and provide other administrative services to us (e.g., companies that help process credit card payments). Our service providers are required by contract to protect the confidentiality of the personal information that we share with them and to use it only to provide specific services on our behalf.
  • To comply with the law or in the good faith belief that such action is necessary in order to comply with the requirements of law or requests from law enforcement or government agencies, to comply with legal process served on us, or to protect and defend our rights or property, including the rights and property of ACCC, or act in urgent circumstances to protect the personal safety of our Users.
  • To prevent or investigate a possible crime, such as fraud or identity theft.
  • As part of a merger, consolidation, or other proposed or enacted business combination.

5. Third Party Web Sites

The Portal may contain links to other third party web sites. ACCC does not endorse and is not responsible for any third party web sites, products, services, or business practices. ACCC assumes no responsibility for the privacy or security of information User may provide to any third party through linked web sites or any other means. We urge User to review the privacy policy of any web site User may visit. We are not responsible for the privacy practices or the content of these other web sites.

6. Security

Any information User transfers to ACCC is done at User’s own risk. ACCC makes reasonable efforts to ensure security on our systems. However, this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of firewalls and secure server software. The safeguards we use reflect, in a commercially reasonable manner, the nature, and scope of our business. ACCC does not make any warranty, express, implied, or otherwise, that ACCC will be able to prevent any loss, misuse, unauthorized access to, or alteration of information User transmits to us through the Portal or otherwise.

In addition, Users are solely responsible for maintaining the confidentiality of any passwords or other account information.

7. Terms of Use

  • Content.
    1. Our Content. The Portal is owned and operated by ACCC. Unless otherwise noted, all text, graphics, content, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, and other material displayed on or that can be downloaded from the Portal (collectively, “Our Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel,” and arrangement of Our Content are owned, controlled, or licensed by or to ACCC, and are protected by copyright, patent, trademark, and various other intellectual property and unfair competition laws. All worldwide rights are reserved.
    2. Your Content. Any content that you upload and provide to ACCC via the Portal is considered “Your Content” for purposes of this Privacy Policy. You agree that Your Content must comply with our Community Guidelines, as updated from time to time. You will indemnify, defend, release, and hold us harmless from any claims made in connection with Your Content.

      Please make sure you are comfortable sharing Your Content on the Portal. You agree that Your Content may be viewed by other Users and any person visiting, participating in or who is sent a link to the Portal. By uploading Your Content on the Portal, you represent and warrant to us that you have all necessary rights and licenses to do so, and automatically grant us a non-exclusive, royalty free, perpetual, worldwide license to use Your Content in any way (including, without limitation, editing, copying, modifying, adapting, translating, reformatting, creating derivative works from, incorporating into other works, advertising, distributing and otherwise making available to the general public such content, whether in whole or in part and in any format or medium currently known or developed in the future).

      We are not responsible for storing Your Content and are unable to provide you with copies of Your Content uploaded to the Portal.
    3. Other Users’ Content. Other Users of the Portal may also share content via the Portal (“User Content”). User Content belongs to the User who posted the content and is displayed via the Portal at the direction of the User providing the User Content. You do not have any rights to other Users’ User Content. You may not use other Users’’ information for commercial purposes, to spam, to harass, stalk or to make unlawful threats. We reserve the right to terminate your Account if you misuse other Users’ information or otherwise violate our policies.
    4. No Content Pre-Screening. While we don’t assume any obligation to pre-screen any of Your Content or any User Content, there may be times where we need to intervene for the safety of our Users, and we reserve the right to review, pre-screen, refuse and/or remove any User Content and Your Content.
    5. Linking to the Portal. Creating or maintaining any link from another web site to any page on the Portal without our prior written permission is prohibited. Running or displaying the Portal or any information or material displayed on the Portal in frames or through similar means on another web site without our prior written permission is prohibited. Any permitted links to the Portal must comply will all applicable laws, rules, and regulations.
  • Linking to the Portal.

    Creating or maintaining any link from another web site to any page on the Portal without our prior written permission is prohibited. Running or displaying the Portal or any information or material displayed on the Portal in frames or through similar means on another web site without our prior written permission is prohibited. Any permitted links to the Portal must comply will all applicable laws, rules, and regulations.

  • Prohibited Actions.
    User may not: (a) reproduce, publish, transmit, distribute, display, modify, reverse engineer, create derivative works from, sell, or participate in any sale of, or commercially exploit in any way, in whole or in part, any of Our Content or the Portal; (b) use any data mining, robots, or similar data gathering or extraction methods; (c) manipulate, duplicate, or otherwise display the Portal, Our Content, or any portion thereof by using framing or similar navigational technology; or (d) use the Portal or Our Content, including any of the features, tools, and service on the Portal, for any reason other than for its intended purpose. User may not attempt to gain unauthorized access to any portion or feature of the Portal, any other systems or networks connected to the Portal, any ACCC server, or any of the services offered on or through the Portal, by hacking, password “mining,” or any other illegitimate means. User may not reverse look-up, trace, or seek to trace any information on any other user or visitor of the Portal, or any other customer of ACCC, including any ACCC account not owned by the User or the Member, to its source. User may not exploit the Portal or any service or information made available or offered by or through the Portal, in any way where the purpose is to reveal any information, including, but not limited to, personal identification or information, other than the User’s own information, as provided for by the Portal. User agrees to not take any action that intentionally imposes an unreasonable or disproportionately large load on the infrastructure of the Portal or ACCC’s systems or networks, or any systems or networks connected to the Portal. User agrees not to use any device, software, or routine to interfere or attempt to interfere with the proper working of the Portal or with any other person’s use of the Portal. User may not use the Portal (including any of Our Content) to solicit the performance of any illegal activity or other activity that infringes the rights of ACCC or others. User acknowledges that User failure to abide by this Privacy Policy may subject User to civil and criminal liability.
  • Acceptable Use.
    Our Community Guidelines form part of this Privacy Policy and outline what content and conduct is accepted on the Portal. User agrees to comply with our Community Guidelines, as may be updated from time to time.
  • Reports and Investigations of Misconduct.
    Users can report any abuse or complain about User Content by contacting us at the contact information listed below in Section 8 of this Privacy Policy. We reserve the right to investigate any possible violations of this Privacy Policy, any Users’ rights, or any third party rights. We may, in our sole discretion, immediately terminate any User’s right to use the Portal without prior notice or refund and/or remove any improper, infringing, or otherwise unauthorized User Content submitted to the Portal. Member (if applicable) and User agree that all terminations for cause shall be made in ACCC’s sole discretion and that ACCC shall not be liable to Member, User, or any third party for any termination of a Portal account.
  • Indemnification.
    Member (if applicable) and each User agrees to indemnify, defend, and hold ACCC, affiliates and subsidiaries, officers, trustees, employees, agents, licensors, suppliers, successors, and assigns, harmless from and against any claims, losses, liabilities, demands, penalties, actions, causes of action, suits, obligations, and expenses, including damage awards, settlement amounts, and reasonable attorneys’ fees, made by any third party due to or arising out of User’s use of the Portal, connection to the Portal, violation of this Privacy Policy, or violation of any rights of another party. This indemnity survives termination of this Privacy Policy.
  • DISCLAIMERS. USE OF THE PORTAL IS AT USER’S RISK. ACCC DOES NOT WARRANT THAT THE PORTAL WILL OPERATE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED OR THAT THE PORTAL OR ITS SERVER WILL BE FREE OF VIRUSES OR OTHER HARMFUL ELEMENTS. THE PORTAL AND OUR CONTENT AND THE SERVICES PROVIDED ON OR THROUGH THE PORTAL ARE PROVIDED “AS IS” WITH ALL FAULTS AND WITHOUT ANY WARRANTIES OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY. NEITHER ACCC, NOR ANY OF ITS RESPECTIVE AFFILIATES, WARRANT THE ACCURACY, RELIABILITY OR COMPLETENESS, QUALITY OR CURRENTNESS OF ANY OF OUR CONTENT OR SERVICES PROVIDED ON OR THROUGH THE PORTAL.

    ACCC is not responsible for the opinions and information posted on the portal by others. We disclaim all warranties with regard to information posted on the portal, whether posted by accc or any third party; this disclaimer includes all implied warranties of merchantability and fitness.
  • LIMITATIONS OF LIABILITY.
    ACCC assumes no responsibility, nor will be liable, for any damages to User’s or the Member’s computer, telecommunication equipment, or other property caused by or arising from User access to, use of, or browsing the Portal.

    In no event shall ACCC be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from loss of use, data, or profits, arising out of or in connection with the use or performance of any information posted on the portal.
  • Domestic Use.
    We control the Portal from our offices within the United States of America. We make no representation that the Portal or Our Content (including, without limitation, any products or services available on or through the Portal) are appropriate or available for use in other locations. Users who access the Portal from outside the United States of America do so on their own initiative and must bear all responsibility for compliance with local laws, if applicable.
  • Governing Law.
    This Privacy Policy shall be governed by the laws of the State of New Jersey, without respect to its conflict of laws principles. We each agree to submit to the personal jurisdiction of a state court located in New Jersey or the United States District Court for the District of New Jersey.
